Abinader promulga Ley 60-23, para administración de bienes secuestrados, incautados, y abandonados

El presidente Luis Abinader publicó la Ley 60-23, la cual tiene por objeto la administración de bienes secuestrados, incautados y abandonados en los procesos penales y en los juicios de extinción de dominio. El nuevo texto legal había sido remitido desde el Senado el pasado miércoles 25. 

La ley establece una serie de principios que rigen la administración de todos los bienes sujetos al ámbito de su aplicación, entre los cuales se encuentran el principio de transparencia y publicidad, principio de eficiencia y economía, principio de objetividad, principio de igualdad y principio de jerarquía.

Entre las novedades que trae consigo está, la creación del Instituto Nacional de Custodia y Administración de Bienes Incautados, Decomisados y en Extinción de Dominio (Incabide), provisto de personalidad jurídica, con autonomía administrativa, financiera y técnica, adscrito al Ministerio de Hacienda, como órgano responsable de la administración y destino de los bienes.

El Incabide estará conformado por un Consejo Directivo, con funciones normativas, deliberativas y de control, y una Dirección Ejecutiva, con funciones administrativas. El referido Consejo Directivo estará integrado por el ministro de Hacienda, quien lo presidirá, el Procurador General de la República, el ministro de Economía, Planificación y Desarrollo y el director ejecutivo del Incabide, quien fungirá como secretario del Consejo Directivo con voz, pero sin derecho a voto.

Por su lado, en el artículo 25, la ley indica una vez que el Ministerio Público practique la incautación o secuestro de bienes, de manera directa, o previa orden judicial, según corresponda, procederá a la entrega al Incabide de dichos bienes, con determinadas reglas y excepciones, como ocurre por ejemplo con las drogas, armas y municiones incautadas, secuestradas, decomisadas o cuyo dominio haya sido declarado extinto, que permanecerán bajo el control del Ministerio Público, quien procederá con estos de conformidad con las disposiciones legales en la materia.

Con relación a los bienes incautados o secuestrados, se indica que Incabide, por razones de interés público o por necesidades de desarrollo de investigaciones criminales, podrá conceder el uso institucional provisional a entidades públicas bajo las condiciones y con excepciones previstas en las leyes.

El anteproyecto de ley también dispone la creación de un Fondo Especial de Bienes Decomisados y Extinguidos (Febide), bajo la administración de Incabide, integrado por los dineros extinguidos o decomisados; los dineros resultantes de las ventas de los bienes extinguidos o decomisados y los dineros resultantes de ventas anticipadas de bienes que posteriormente hayan resultado extinguidos o decomisados, etc. 

Una vez conformado el fondo, se pagará con cargo al mismo, lo relativo a los gastos de administración de los bienes o cualquier otro gasto u obligación que haya generado el bien, así como el pago a los terceros de buena fe, los pagos a víctimas dispuestos por sentencia judicial, entre otros. El dinero restante se depositará en la Cuenta Única del Tesoro y el Gobierno central podrá utilizar los fondos para apoyar, fortalecer, financiar, desarrollar o ejecutar programas de prevención o tratamiento en consumo de drogas, reducción de pobreza, protección o apoyo de menores, apoyo y protección de víctimas de infracciones penales, protección de fronteras, entre otros, siempre con estricto apego a los principios de transparencia y publicidad. 

Como manifestó el presidente Abinader al remitir la propuesta normativa al Congreso Nacional, esta novedosa ley ajusta sus disposiciones a los mandatos Constitucionales actuales, a la reciente ley de extinción de dominio, y al interés y compromiso de la presente administración con el fortalecimiento institucional y el incremento de los niveles de transparencia y eficiencia administrativa.
